heycar Terms of Use

We all like knowing where we stand. That’s why we’ve got these Terms of Use, for consumer users of heycar.

Introduction

These are the terms and conditions of use for our services, including those provided through heycar.co.uk (Site) and and through buyacar.co.uk (Site) (together the “heycar Service”) . The heycar Service is operated by or on behalf of Mobility Trader UK Limited trading as heycar (we, us and our). We are a limited company, registered in England. Our registered company number is 12016686, and our registered office is at 5 New Street Square, London, United Kingdom, EC4A 3TW. Mobility Trader UK Limited is an appointed representative of:

  1. Volkswagen Financial Services (UK) Limited, which is authorised and regulated by the Financial Conduct Authority with firm reference number 311988; and
  2. Wrisk Transfer Limited (Wrisk) which is authorised and regulated by the Financial Conduct Authority, with firm reference number 788062

Our VAT registration number is 326461802.

Your use of the heycar Service will be subject to these terms and conditions and by using the heycar Service you agree to be bound by them. Any Vehicles you purchase through the heycar Service are supplied subject to our heycar Purchase Terms.

We reserve the right to change these terms and conditions from time to time by changing them on the Site. These terms and conditions were last updated on 8th August 2024.

The heycar service

The heycar Service provides information about vehicles, and insurance and financing and leasing options which are available from our partner dealerships and other partners.

The heycar Service also allows you to

a. communicate directly with our selected dealerships about vehicles you are interested in;

b. chat with our customer service team to help you find the right car for you; 

c. create saved searches and get notifications if a car matching your criteria becomes available; and

Please note that the Site contains details of vehicles, and insurance, financing and leasing options which are provided by third parties and any agreements for the purchase or leasing of such vehicles, and related insurance and/or credit or hire arrangements are between you and the relevant selected dealer, insurance provider, credit provider or hire provider (as applicable). Such third parties may charge for additional products and services relating to vehicles which may include admin fees on vehicle purchases.

Heycar is a credit broker acting as an appointed representative of Volkswagen Financial Services (UK) Limited and is not a lender. Details of our appointed representative status are set out in the Introduction above. 

Heycar is not an insurance broker or insurer; however, we may make introductions to Wrisk, which is a third-party insurance broker and heycar is not part of Wrisk's group of companies. Heycar does not make any recommendations as to whether a particular insurance policy is suitable for you. The products provided by or through Wrisk meet the demands and needs of customers who meet the relevant insurer's acceptance criteria, and who wish to insure against the risks arising from driving and/or owning a vehicle, including risks of damage to that vehicle, and others' property and/or liability arising out of any injury or damage caused to others through vehicle ownership.  Further details on the cover provided should be sought from the insurer.

Any vehicles you purchase directly through the heycar Service are supplied subject to our heycar Purchase Terms, provided that where you make a purchase on finance through our third-party finance providers, we will pass on your enquiry to the relevant third party finance provider(s) and any such arrangement will be governed by a separate agreement between you and the relevant finance provider. Any purchase of insurance by you will be governed by a separate agreement between you and the relevant insurance provider.  Where an insurance policy is taken out as a result of our introduction, we will receive a commission payment (which is a set amount) each month for the first 12 months of the policy.

While we take steps to ensure that vehicles offered by our selected dealerships through the Site meet our high standards for vehicle testing and quality requirements, we are not responsible for, and provide no guarantee or warranty in relation to, the quality of any vehicle you purchase from our selected dealers or for any information or other products or services provided by our selected dealers.

If the heycar Service provides professional information (for example, financial or legal), such information is for informational purposes only and should not be construed as financial or other professional advice. No action should be taken based upon any information provided through the Site. It is your responsibility to ensure that any third party financing and leasing options and any insurance policy you may enter into are suitable for you. You should seek independent professional advice from a person who is licensed and/or qualified in the applicable area.

Access to the heycar Service

The heycar Service is intended for use only by persons who are at least 18 years of age. By using the heycar Service, you confirm to us that you meet this requirement.


It is your responsibility to ensure your equipment (computer, laptop, netbook, tablet or other mobile device) meets all the necessary technical specifications to enable you to access and use the heycar Service and is compatible with the heycar Service. The Site is designed to work best with Google Chrome.

We cannot guarantee the continuous, uninterrupted or error-free operability of the heycar Service. There may be times when certain features, parts or content of the heycar Service, or the entire Service, becomes unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion, without notice to you. You agree that we will not be liable to you or to any third party for any unavailability, modification, suspension or withdrawal of the heycar Service, or any features, parts or content of the heycar Service.

What you are allowed to do

You may only use the Site for non-commercial use and only in accordance with these terms and conditions. You may retrieve and display content from the Site on a computer screen, print and copy individual pages and, subject to the next section, store such pages in electronic form. Additional terms may also apply to certain features, parts or content of the Site and, where they apply, will be displayed on-screen or accessible via a link.

What you are not allowed to do

Except to the extent expressly set out in these terms and conditions, you are not allowed to:

  • 'scrape' content or store content of the Site on a server or other storage device connected to a network or create an electronic database by systematically downloading and storing all of the content of the Site;
  • remove or change any content of the Site or attempt to circumvent security or interfere with the proper working of the Site or the servers on which it is hosted; or

You must only use the Site and anything available from the Site for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates. 

All rights granted to you under these terms and conditions will terminate immediately in the event that you are in breach of any of them. CAP HPI has a right to enforce any breach of the heycar terms directly against a visitor.

Intellectual property rights

All intellectual property rights in any content of the Site (including text, graphics, software, photographs and other images, videos, sound, trade marks and logos) are owned by us or our licensors. Except as expressly set out here, nothing in these terms and conditions gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the Site. In the event you print off, copy or store pages from the Site (only as permitted by these terms and conditions), you must ensure that any copyright, trade mark or other intellectual property right notices contained in the original content are reproduced.

Content

We may change the format and content of the Site from time to time. You agree that your use of the heycar Service is on an 'as is' and 'as available' basis and at your sole risk.

Whilst we try to make sure that all information contained on the Site (other than any user-generated content) is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information.

We make or give no representation or warranty as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of any content of the Site and, to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded and we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else using the Site or relying on any of its content.

We cannot and do not guarantee that any content of the Site will be free from viruses and/or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content.

Your personal information and cookies

Use of your personal information submitted to or via the heycar Service is governed by our Privacy Policy. Our Site also uses cookies. For more information, please see our Cookies Policy.

User content

The Site may, from time to time, allow you to upload user-generated content and may also allow you to communicate that content, either to selected recipients or in public areas, such as comments pages, and/or reviews (collectively User Content Areas). We do not control the material submitted to User Content Areas (collectively User Submissions), nor are User Content Areas actively moderated. You are solely responsible for the content of your User Submissions as submitted by you and acknowledge that all User Submissions express the views of their respective authors, and not our views.

If you participate in any User Content Areas, you must keep all User Submissions relevant to the purpose of the User Content Area and the nature of any topic.

User Submissions must not:

  • contain, transmit, distribute, link to or otherwise make available, or advertise or promote any content that infringes any intellectual property rights or data protection, privacy or other rights of any other person, is defamatory or in breach of any contractual duty or any obligation of confidence, is obscene, sexually explicit, threatening, abusive, harassing, inciteful of violence or hatred, blasphemous, discriminatory (on any ground), liable to cause anxiety, alarm or embarrassment, knowingly false or misleading, or that does not comply with all applicable laws and regulations or is otherwise objectionable ("Prohibited Content");
  • impersonate any person or entity or otherwise misrepresent your relationship with any person or entity;
  • contain, transmit or distribute any unsolicited or unauthorised advertising, marketing or promotional material or other form of solicitation (spam); or
  • transmit or distribute any virus and/or other code that has contaminating or destructive elements.

You agree that, by submitting any User Submission, you grant us and our affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Submission (in whole or part) and/or to incorporate it in other works in any form, media or technology, and you waive any moral rights you may have in, or to be identified as the author, of such User Submission.

Whilst we do not pre-screen User Submissions, we reserve the right, in our sole discretion, to delete, edit or modify any User Submission submitted by you and/or to close any topic, at any time without notice to you.

Complaints about the content of any User Submission must be sent to privacy@heycar.co.uk and must contain details of the specific User Submission giving rise to the complaint.

External links

The Site may, from time to time, include links to external sites, which may include links to third party offers and promotions. We include these to provide you with access to information, products or services that you may find useful or interesting. We are not responsible for the content of these sites or for anything provided by them and do not guarantee that they will be continuously available. The fact that we include links to such external sites does not imply any endorsement of or association with their operators or promoters.

Our liability

Nothing in these terms and conditions shall limit or exclude our liability to you:

  • for death or personal injury caused by our negligence;
  • for fraudulent misrepresentation;
  • for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded; or
  • for any other liability that, by law, may not be limited or excluded.

Subject to this, if you are a consumer and not a business user, in no event shall we be liable to you for any business losses, and if you are a business user, in no event shall we be liable to you for any indirect or consequential losses, or for any loss of profit, revenue, contracts, data, goodwill or other similar losses, and any liability we do have for losses you suffer shall not exceed £150 in respect of any one event or series of events and is strictly limited to losses that were reasonably foreseeable.

Terms and conditions

The heycar £200 cash back (Buy online only) and £500 (exclusively delivered by heycar) cash back promotion is provided by Mobility Trader UK Limited trading as heycar ("we", "us" and "our"). We are a limited company, registered in England. Our registered company number is 12016686, and our registered office is at 5 New Street Square, London, United Kingdom, EC4A 3TW. Our website is at heycar.com/uk (the "heycar site") use of which is also subject to our heycar Terms of Use.

By registering for our cashback offer, you will be deemed to accept these terms, together with all claim instructions which form part of these terms.

For the avoidance of doubt, nothing in these terms shall constitute a product warranty or a contract of insurance. For warranty information, please refer to our separate product warranty terms provided at the time of vehicle purchase.

What is the heycar cashback offer?

If you:

  1. Place a deposit on any buy online vehicle cash or finance on the heycar website from December 2nd - December 31st ("Promotion Period")
  2. Finalise purchase of that vehicle within 14 days of placing the deposit.
  3. The Vehicle you purchase will be driven to your home address, with delivery details to be agreed upon at the time of purchase. Usually within 7 days of having finalised the purchase of the vehicle and not exceeding 30 days.
  4. A member of our After Sales team will request your bank details 14 days after your purchase, to arrange your cashback via email. These details will be processed in accordance with our privacy policy, which you can access here.
  5. Cashback will be paid within 14 days of receiving your bank account details, and may take 2-5 days to appear in your account then, subject to these terms and conditions, we will pay you either £200 in cashback if you buy a vehicle through a dealership, or £500 in cashback - if your vehicle is exclusively delivered by heycar.

Eligibility

In order to be eligible for the heycar cashback offer, you and your chosen vehicle must meet all of the following eligibility criteria:

  1. Eligible Purchase: You must have completed the purchase of a ‘Buy Online’ vehicle or a vehicle exclusively delivered by heycar, during the promotion period.
  2. Single Claim: The cashback offer is limited to one vehicle purchase per individual. You must not have previously made a successful claim under any heycar cashback promotion.
  3. New Transactions Only: Only purchases made during the specified promotion period are eligible for this offer.
  4. UK Residency Requirement: You must be a resident of the United Kingdom (excluding Northern Ireland).

Exclusions:

  • You must not be an employee of heycar, its agents, suppliers, or any affiliated companies.
  • You must not be connected personally or professionally with the dealer.
  • Immediate family members or household members of any of the aforementioned individuals are also ineligible.

For the purposes of this promotion, an ‘affiliated company’ refers to any entity that directly or indirectly controls, is controlled by, or is under common control with heycar. Control meaning ownership of more than 50% of the voting securities, or the ability to direct or cause the direction of the management and policies of the entity, whether through the ownership of voting securities, by contract or otherwise.

We reserve the right to refuse or reduce the amount paid in relation to a claim in our sole discretion if:

  • You cancel your purchase and/or return the vehicle for any reason;
  • You make a successful claim in relation to the purchase under the heycar moneyback guarantee;
  • We suspect any breach of applicable law, including in relation to fraud, money laundering or other dishonesty relating to the claim.

How do I get my cashback?

  1. Wait 14 days after completing your purchase.
  2. On the 14th day, look out for an email from help@heycar.co.uk. This email will allow you to book a call at a time and date of your choice,within the availability of our customer service team, during which we will securely collect your bank details over the phone.
  3. Please note that GDPR checks will be conducted during the call to ensure your information is handled securely and in compliance with data protection regulations.
  4. You have 21 days from receiving this email to schedule and complete the call. It is only after this call that your acceptance of the cashback offer will be confirmed.
  5. Once you have provided your details and the call is completed, you will receive the cashback in your bank account within 14 days.

How long do I have to make a claim?

In the event that we have not received a positive response from you within 28 days of notification, you will forfeit your rights to the cashback promotion.

What happens when my claim is accepted?

If your claim is successful, we will pay you £200 or £500, depending on your eligibility, via bank transfer to the UK bank account used to purchase the vehicle within 14 days of receiving your bank account details.

Our Liability

Nothing in these terms shall limit or exclude our liability to you:

  • for death or personal injury caused by our negligence;
  • for fraudulent misrepresentation;
  • for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded; or
  • for any other liability that, by law, may not be limited or excluded.

Subject to this, in no event shall we be liable to you for any business losses, and any liability we do have for losses you suffer arising out of or in relation to these terms is strictly limited to losses that were reasonably foreseeable and shall not exceed £500. Losses are foreseeable where they could be contemplated by you and us at the time you purchase the vehicle. For the purposes of these terms, 'business losses' refer to any losses related to loss of profits, business interruption, or loss of business opportunity.

We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations under these terms that are caused by events outside our reasonable control.

Data Collection and Use

Your bank details will be collected solely for the purpose of processing your cashback claim. The details will be used exclusively for this purpose and will not be shared with third parties without your explicit consent, except as required by law.

Data Security

We implement robust security measures to protect your personal and financial information from unauthorised access, loss, or alteration. This includes employing encryption and secure storage practices.

Data Retention

Your bank details will be retained only for as long as necessary to process your cashback and comply with any legal obligations. Once your cashback has been successfully processed and the retention period has expired, your bank details will be securely deleted or anonymised in accordance with our data retention policy.

GDPR Compliance

We are committed to complying with the General Data Protection Regulation (GDPR) and other applicable data protection laws. You have the right to request access to, correction of, or deletion of your personal data, subject to applicable legal exceptions.

Other Important Terms

We reserve the right to amend, extend, or withdraw heycar £200 cash back (Buy online only) and £500 cashback (exclusively delivered by heycar) at any time, on reasonable notice, provided that no such amendment, extension, or withdrawal will affect your rights in relation to vehicles already purchased at the time the amendments or withdrawal comes into effect. Reasonable notice shall typically be considered as a minimum of 7 days' notice, except in cases of regulatory changes or other unforeseen circumstances where shorter notice may be required.

If such changes could materially affect your eligibility or rights under this promotion, we will notify you via email using the contact information provided during your vehicle purchase or by other appropriate means. In the event of such amendments, extensions, or withdrawals, any purchases made before the effective date of the change will remain eligible under the terms that were in effect at the time of purchase.

You may not transfer or assign any or all of your rights or obligations under these terms.

If we fail to enforce any of our rights, that does not result in a waiver of that right. If any provision of these terms is found to be unenforceable, all other provisions shall remain unaffected.

These terms and any document expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of the heycar £200 cash back (Buy online only) and £500 cashback (exclusively delivered by heycar) offer. These terms may not be varied except with our express written consent.

These terms shall be governed by English law, except that (if you are a consumer and not a business user) and if you live in Scotland, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law.

You agree that any dispute between you and us regarding these terms will only be dealt with by the English courts, except that (if you are a consumer and not a business user) and if you live in Scotland, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.

If you will not be present to accept the delivery, or can no longer collect the vehicle on the agreed collection date, you must contact us by telephone on 0330 808 3819 at least 24 hours prior to the scheduled collection/delivery time (as applicable) to rearrange your collection/delivery.

General

These terms and conditions shall be governed by English law, except that (if you are a consumer and not a business user) and if you live in a country (which, for these purposes, includes Scotland or Northern Ireland) of the European Union other than England, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law.

You agree that any dispute between you and us regarding these terms and conditions or the Site will only be dealt with by the English courts, except that (if you are a consumer and not a business user) and if you live in a country (which, for these purposes, includes Scotland or Northern Ireland) of the European Union other than England, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.

Complaints

We take all complaints seriously. Please let us know if you’re not happy with our site or if we’ve made a mistake so that we can try to put things right. You can do this by contacting us using the details in the section below entitled "Contacting us". We will investigate your complaint straight away and will provide a written response.

If your complaint relates to finance or leasing and we cannot resolve your complaint within one business day, we will refer your complaint to our principal firm, Volkswagen Financial Services (UK) Limited, to complete and communicate the outcome of the investigation to you. If your complaint relates to insurance and we cannot resolve your complaint within one business day, we will refer your complaint to our principal firm, Wrisk Transfer Limited, to complete and communicate the outcome of the investigation to you.

If you’re not happy with how we’ve handled your complaint, or you have not heard from us (or our principal firm) within eight weeks of us receiving your complaint,  and you are an eligible complainant as defined by the Financial Conduct Authority, you can contact the Financial Ombudsman Service. The Financial Ombudsman Service is an independent organisation that helps to resolve complaints. You can contact them:
